Terms and Conditions of MyBoysTown® Usage (Terms and Conditions)

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING MYBOYSTOWN®. YOUR USE OF MYBOYSTOWN® CONFIRMS YOUR UNCONDITIONAL ACCEPTANCE OF THESE TERMS AND CONDITIONS. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS, DO NOT USE MYBOYSTOWN®.

Purpose and Terms of Use

We are pleased to provide patients with a secure Internet-based environment that will provide the option of accessing selected portions of their confidential medical record, such as basic laboratory results, immunization records and visit history. This online environment is called MyBoysTown®. To request a MyBoysTown® account, please sign up during your office visit or by calling your physician’s office. MyBoysTown Your medical information released to MyBoysTown® is at the discretion of your physician. MyBoysTown® can be accessed with the Epic MyBoysTown® mobile application available from the iTunes App Store.

We think it is important for you to know how we handle information we communicate via the Internet. This Terms and Conditions statement outlines our practices and our sensitivity to your right to privacy. You agree to use MyBoysTown® appropriately and as intended. You may not communicate with physicians or staff in an unlawful, threatening, defamatory, obscene or abusive manner. We reserve the right, in our sole discretion, to revoke access at any time for any reason. The MyBoysTown® mobile application is intended for use on a mobile device that is running an unmodified manufacturer-approved operating system. Modifying the mobile operating system (known as "Jailbreaking") may undermine the security features intended to protect your health information from unauthorized or unintended disclosure. Accessing your MyBoysTown® account on a mobile device with a modified operating system is a material breach of these Terms and Conditions.

Please note the medical or health care information provided on MyBoysTown® is not a replacement for proper medical attention or advice. The electronic record is property of Father Flanagan’s Boys Home d/b/a Boys Town National Research Hospital and the information displayed in MyBoysTown® is not the complete medical record.

You can choose to stop participating in MyBoysTown® at anytime by contacting your physician office and making a request for your MyBoysTown® record to be closed.

Access, correction, and data integrity

We will attempt to maintain the accuracy of information on MyBoysTown®, but we make no guarantees as to its completeness, or accuracy. If you believe the information found on MyBoysTown® is inaccurate, please contact us at (531) 355-6589 or email at medical.records@boystown.org.

Response to Electronic Communication

We will use best efforts to provide a timely response to electronic inquiries. In some cases, the office/clinic staff that need to respond to an electronic inquiry or other communication may not be immediately available so you should allow at least three (3) business days for a response. Accordingly, emergency situations requiring immediate attention should never be submitted electronically. You should call 911 or visit your local hospital.

Furthermore, with respect to any electronic communications sent by you, we are only able to respond to such communications based on the information provided by you. If there is insufficient information provided in your communications, we will be unable to provide accurate, timely and reliable services.

E-mail Privacy

As a user of MyBoysTown®, you should be aware that you will be notified via e-mail when there is new medical information to be viewed on MyBoysTown®. This means that any person with access to your e-mail account will be able to see this notification. This could include your spouse, employer or anyone else that can access a patient's e-mail account. Although no private medical information will be sent, the notification that new medical information is available by accessing MyBoysTown® may be information that you may not want others to know. Thus, you should take this into consideration when providing an e-mail address for your MyBoysTown® account.

Please note that if you send us an e-mail communication, it may be shared with the staff that assist the physician in providing your medical care. Your confidential medical information on MyBoysTown® will be accessible only to appropriate clinical staff on a need-to-know basis. Other than Proxy access, all communication through MyBoysTown® should be in regard to your health condition and no one else's. All communications through MyBoysTown® will be saved as a permanent part of the patient's medical record. We do not assume any responsibility for health information or services used by persons other than the MyBoysTown® enrollee.

Web Site Links

MyBoysTown® may offer links to related medical Web sites that we do not manage. These Web site link(s) are for informational purposes only. We do not endorse and have not verified the accuracy of the information in/on these Web sites, and you should not rely on any of the information found on these Web sites for purposes of treatment or diagnosis.

Security and Confidentiality

We afford the same degree of confidentiality to medical information stored on MyBoysTown® as is given to medical information stored in any other medium. We are committed to protecting the confidentiality of your medical information. We limit employee access and ability to enter or view information based upon their role in your care. Firewalls, passwords, encryption, and audit trails are further used to safeguard your information. We shall identify the records released and note the time and date of access each time you access MyBoysTown®. We have taken steps to make all information received from MyBoysTown® users as secure as possible against unauthorized access and use.

For other than general information viewing, MyBoysTown® must be accessed with a Secure Sockets Layer (SSL) compatible browser or terminal (Netscape or Internet Explorer versions 5.0 or greater). Our SSL web server uses authentication and offers the highest level of encryption technology commercially available (128-bit RC4). You can tell when you are secure by looking at the location (URL) field. If the URL begins with https:// (instead of http://), the document comes from a secure server. This means your medical information cannot be read or deciphered by unauthorized individuals.

Usernames and passwords provide two layers of authentication and are stored in an encrypted database that is isolated from the Internet. As a MyBoysTown® user, your role in maintaining the security of your medical information is: 1) Changing your password on a regular basis, and 2) Keeping your login ID and password confidential. We are not responsible for someone breaching your patient information if you shared your login ID or password with that person.

To further protect your MyBoysTown account, we enabled two-factor authentication. This provides an extra layer of security during the log-in process by requiring you to enter an authentication code after entering your password.

MyBoysTown® may not be available to you at all times due to system maintenance or other causes beyond our control. Access is provided as an "as-is, as-available" basis and we do not guarantee that you will be able to use MyBoysTown® at any particular time. During times when MyBoysTown® is unavailable, other communication methods (e.g., telephone, in-person visits) should be used to access your physician's offices. MyBoysTown® is provided for your convenience, and its availability is not an entitlement, right or privilege.

Realize that your activities within MyBoysTown® may be tracked by computer audit and that entries you make may become part of the medical record. You are solely responsible for any action taken in confidence on any entries you make in MyBoysTown® and/or the medical record.

Minor Eligibility

Parents or guardians of minor children may request access to the minor child's account by following the terms outlined in the "Proxy Access" section of this Terms and Conditions statement. Minor children between the ages of 14 and 18 (inclusive) will not be eligible to participate in the full spectrum of MyBoysTown® services. Under State and Federal law, there are certain types of medical information that the parent or guardian of a minor patient age 14 or older may not view without consent of the minor patient. Because of these requirements, we cannot offer the full spectrum of services to parents of minor patients in this age category. Thus, when a minor patient reaches age 14, restrictions will be placed on MyBoysTown® access until he/she reaches age 18. Parental access will terminate once a child reaches the age of 18.

MyBoysTown Proxy Access

What is MyBoysTown Proxy Access?

MyBoysTown proxy access allows an authorized person to access data in another person's MyBoysTown healthcare record and/or mobile application. Health information accessible in MyBoysTown includes but is not limited to: past and future appointments, all messages to and from my healthcare provider(s), lab and radiology test results, immunizations and billing information.

Often parents/legal guardians will use this mechanism to access their children's MyBoysTown accounts (typically, up until the child turns 18) so they can schedule appointments, check immunizations, view test results, and coordinate other health-related information for their children, as permitted by state and federal law. Adults may use authorized proxy access to view a spouse, older parent or relative's information maintained in the MyBoysTown healthcare record. This can be particularly useful for helping monitor medications and appointments.

In any proxy relationship, two people are involved. One of these is the patient whose chart is being accessed. The other is the person (i.e., the proxy) who receives authorization from the patient to access the patient's health information.

How Do I Authorize and Terminate Proxy Access to MyBoysTown?

Authorization is granted differently for minor patients and adult patients.

In a Parent/Legal Guardian-Child relationship, the parent/legal guardian coordinates access to the child patient's MyBoysTown account through the child's healthcare provider.  Once access is authorized, the parent/legal guardian can view the health information maintained in the child's MyBoysTown account.  When child reaches age 18, proxy access is automatically terminated, and the parent/legal guardian will no longer have access to the child's MyBoysTown record. In cases where the legal guardian is a caseworker or guardian ad litem, or the primary caregiver is not the legal guardian (foster parents, family teachers), the patient portal is not available.  The patient portal will not be available to parents with parental rights, but not legal guardianship who have protective orders against them.  Records can be accessed by contacting Health Information Management at medical.records@boystown.org or calling 531-355-6589. 

In an Adult-Adult relationship, the adult patient coordinates access to his/her MyBoysTown account via the online MyBoysTown application portal.  MyBoysTown proxy access will only be granted to those persons authorized by the adult patient and who already have a registered MyBoysTown account.  Adult proxy access can be terminated by the patient upon submitting a written request to Boys Town and/or the patient's initiation of a change in his/her proxy access in the MyBoysTown portal.

Proxy Access Terms and Conditions

Please read carefully.  By authorizing proxy access using your MyBoysTown application portal, you agree that you've read, understand, and agree to the terms and conditions below:

  1. I understand that by granting proxy access to a third-party person, I am allowing that person's access to the complete contents of my MyBoysTown record. I understand that granting proxy access to a third party is completely voluntary.
  2. I understand that it is my responsibility to terminate my proxy's access to my MyBoysTown account if I no longer wish to allow him/her access to my MyBoysTown information. Termination of proxy access may not be immediate. Boys Town will use its best efforts to terminate your proxy's access within ten (10) business days of receiving a written request and/or receipt of the change in proxy access in the MyBoysTown portal.
  3. I understand that if my proxy shares his/her user ID and password with anyone, or if his/her user ID and password are lost or stolen, unauthorized parties may have access to my MyBoysTown health information. I understand that it is the responsibility of my proxy to keep his/her user ID and password secure and to change them anytime they believe their security has been compromised. I agree that it is also the responsibility of my proxy to log out of active MyBoysTown sessions and take appropriate precautions when accessing MyBoysTown from his/her home, business, or public computer and when printing or copying any MyBoysTown health information.
  4. I understand that my proxy's activities within MyBoysTown may be tracked by computer audit and that any entries and messages may become part of the medical record.
  5. I understand that access to MyBoysTown is provided a​s a convenience to me as a patient and that Boys Town has the right to deactivate my access or my proxy's access at any time for any reason or for no reason.
  6. I understand that my use of MyBoysTown is voluntary and that I am not required to use MyBoysTown.
  7. I hereby agree to waive any and all claims or causes of action against Boys Town, its affiliated entities, their officers, directors, employees, and agents that are in any way related to my proxy's use of MyBoysTown.
  8. I understand my authorization for a person's proxy access will remain in effect until revoked in writing or changed by me in the MyBoysTown portal.

MyBoysTown Multi-Factor Authentication (MFA) Terms and Conditions

  1. MyBoysTown MFA is a program that will send a one-time use verification code via SMS that you enter while logging into MyBoysTown. This extra layer of security helps ensure that you’re the only person who can log in to your account, even if someone else knows your username and password.
  2. You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, please follow instructions on your account settings page to activate SMS, and we will start sending SMS messages to you again.
  3. If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly at 888-986-3729.
  4. Carriers are not liable for delayed or undelivered messages. Message and data rates may apply.
  5. Message frequency will be one message per request. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

IN NO EVENT WILL  BOYS TOWN OR ANY OF ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, SUCCESSORS OR ASSIGNS BE LIABLE TO YOU OR ANYONE ELSE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF MYBOYSTOWN® OR THE MATERIALS, INFORMATION OR SERVICES CONTAINED ON ANY OR ALL SUCH WEB SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
